APPEAL TO ALL 'X' GROUP VETERANS

Dear ‘X’Group Veterans, 

Everybody may be in knowledge of injustice done to Pre-2016 X-Group veterans in OROP-2 and OROP-3 by placing them in ‘Table-7’ and keeping post 2016 Veterans in ‘Table-8’ and started recovery from some  Pre 2016 X-group veterans as their Basic pension was more comparison to table 7.

In this connection myself Sgt.Susil Kumar Choudary (Retd.) along with other 42 members representing all States have filed a WP(C) 796/2023 in Hon’ble Supreme Court of India. Later on some other groups have also filed similar cases in the Hon’ble Supreme Court and they were tagged to our case, because of which hearing of our case was delayed and now it has come on the bench for hearing as Union of India has filed Counter affidavit. So far for all these hearings and adjournments, we have not collected any money from Veterans as I have friendship with Adv Amitesh Chandra Mishra who is heading ACM Legal and who is having sympathy with veterans and defence personnel and has brought this case to this stage without taking any charge. The next hearing of Our case is likely to be on 05.01.2026. 

Now it is do or die situation for all X-group veterans. Our legal team is suggesting for a Senior Counsel to appear in our case. We have chosen a Senior Counsel who is the best at Service Matters and  likely to charge about 2.2 lakhs for rejoinder draft vetting  and thereafter 3.5 lakhs for each appearance. The hearing may go up to 5 dates or may be decided in less hearings. Therefore, hearing cost may go around 20 lakhs in total. 

  Therefore, we request all the  ‘X’ Group Veterans to contribute generously for the noble cause and pay at least Rs.1000/-  in the following account number, which is chosen for the purpose of legal expenditure of this particular case. We the petitioners in the case have already decided to contribute Rs.5000/- each.

    It is brought to the notice of all X-group Veterans that  Decision against WP (C) 796/2003 will decide the petitions against all connected matters in the Supreme Court and any other lower Court including AFT. Therefore, all other petitioners’ groups are requested to support this case to avoid any adverse result to come out.

    It is also brought to the notice of all Veterans including ‘Y’ group that if the matter is decided otherwise, Govt may bring another cutoff date for all the Pensioners in the ensuing 8th Pay Commission. The recent amendment in Finance Bill brought changes in Pension Rules,1972 and the Govt has taken full authority to bifurcate the category of pensions based on date of retirement. So, this judgement is going to effect all Veterans irrespective of group X or Y.

Once again pre-2016 ‘X’ Group sergeants are downgraded in OROP-II


The Table No 7 & 8 issued along with circular 666  by the implementing Agency for the revision of Pension w.e.f.01/09/2019 has divided a homogeneous class of Retirees to Pre & Post 2016 between the above two tables & has created a class within class namely Pre2016 OROP Pensioners & Post 2016 OROP pensioners  which is against the  cabinet approved & President assented Principle contained in both of the OROP notifications.

The basic Pension as a sergeant of Group X with Rs 6200 as X Group pay having 15 years of Qualifying service as shown in Table 8 Rs 25920 as basic Pension is denied on the basis of date of retirement in Pre 2016 which calls for the intervention of the court.  All the X GP Veterans with X GP Pay of Rs 6200 & discharged Prior to 01/01/2016 in the Rank of Sergeant with 15 years of qualifying service is illegally included in Table No7 showing basic only as Rs 24160. 

Therefore, all the ‘X’ Group sergeants are requested to study the matter and get prepared to file a case in AFT in due course.

 IT IS UNDERSTOOD THAT THE OROP-2 TABLES ARE READY AND  ORDERS ARE EXPECTED  NEXT WEEK. 

DO NOT EXPECT MIRACLES AND GET DISAPPOINTED, THE INCREASE MAY BE VERY LITTLE AS THE GAP BETWEEN OLD AND NEW PENSIONS IS NOT MUCH. AS ALL OF YOU KNOW THE MACP BENIFIT  IS NOT ACCEPTED BY HON'BLE SUPREME COURT TO  OLD PENSIONERS, THE INCREASE MAY BE MINIMAL. AS PER MY VIEW IT MAY BE AROUND 500 TO 1500.

Cabinet approves modifications in the 7th CPC recommendations on pay and pensionary benefits

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved important proposals relating to modifications in the 7th CPC (Central Pay Commission) recommendations on pay and pensionary benefits in the course of their implementation. Earlier, in June, 2016, the Cabinet had approved implementation of the recommendations with an additional financial outgo of Rs 84,933 crore for 2016-17 (including arrears for 2 months of 2015-16).

The benefit of the proposed modifications will be available with effect from 1st January, 2016, i.e., the date of implementation of 7th CPC recommendations. With the increase approved by the Cabinet, the annual pension bill alone of the Central Government is likely to be Rs.1,76,071 crore.  Some of the important decisions of the Cabinet are mentioned below:

1.        Revision of pension of pre – 2016 pensioners and family pensioners
The Cabinet approved modifications in the recommendations of the 7th CPC relating to the method of revision of pension of pre-2016 pensioners and family pensioners based on suggestions made by the Committee chaired by Secretary (Pensions) constituted with the approval of the Cabinet.  The modified formulation of pension revision approved by the Cabinet will entail an additional benefit to the pensioners and an additional expenditure of approximately Rs.5031 crore for 2016-17 over and above the expenditure already incurred in revision of pension as per the second formulation based on fitment factor.  It will benefit over 55 lakh pre-2016 civil and defence pensioners and family pensioners.

While approving the implementation of the 7th CPC recommendations on 29th June, 2016, the Cabinet had approved the changed method of pension revision recommended by the 7th CPC for pre-2016 pensioners, comprising of two alternative formulations, subject to the feasibility of the first formulation which was to be examined by the Committee.

In terms of the Cabinet decision, pensions of pre-2016 pensioners were revised as per the second formulation multiplying existing pension by a fitment factor of 2.57, though the pensioners were to be given the option of choosing the more beneficial of the two formulations as per the 7th CPC recommendations.

In order to provide the more beneficial option to the pensioners, Cabinet has accepted the recommendations of the Committee, which has suggested revision of pension based on information contained in the Pension Payment Order (PPO) issued to every pensioner.  The revised procedure of fixation of notional pay is more scientific, rational and implementable in all the cases.  The Committee reached its findings based on an analysis of hundreds of live pension cases.  The modified formulation will be beneficial to more pensioners than the first formulation recommended by the 7th CPC, which was not found to be feasible to implement on account of non-availability of records in a large number of cases and was also found to be prone to several anomalies. 

2.         Disability Pension for Defence Pensioners

The Cabinet also approved the retention of percentage-based regime of disability pension implemented post 6th CPC, which the 7th CPC had recommended to be replaced by a slab-based system.
           
The issue of disability pension was referred to the National Anomaly Committee by the Ministry of Defence on account of the representation received from the Defence Forces to retain the slab-based system, as it would have resulted in reduction in the amount of disability pension for existing pensioners and a reduction in the amount of disability pension for future retirees when compared to percentage-based disability pension. 

The decision which will benefit existing and future Defence pensioners would entail an additional expenditure of approximately Rs. 130 crore per annum.
