HISTERY OF TABLE 7&8 ON 'X' GROUP PAY

Respected X-group veterans *Brief History of case* When PCDA issued a circular for implementation of OROP-2 on 20.01.2023, we came to know the disparity between pension of Pre 2016 and Post 2016 X-group veterans as separate tables table 7 and 8. To challenge this issue in the court, my friend ACM Legal head Adv Amitesh Chandra Mishra came forward on Pro Bono basis. I, along with other 11 petitioners had filed an Intervention Application i.e. MA499/2023 in the Supreme Court which was misconceived on 17.04.2023 on technical ground by the CJI bench. Then, One NAVAL association and Voice of Ex-servicemen filed a Writ Petition in the Supreme Court which was also disposed of and sent to AFT in July 2023. Meantime, I along with other 42 petitioners across India filed Writ Petition i.e. WP(C) 796/2023 in the Supreme Court which was heard by CJI Bench in August 2023 and Notice issued to Union of India. Then, some of the Air veterans, who were Petitioners with me in MA 499/2023 but didn't join in Writ Petition 796/2023, formed Technical Air veterans Welfare association (TAVWA) and filed another Writ Petition 1324/2023 in Nov 2023 which tagged with our Writ Petition 796/2023. Further two more Writ Petition 126/2024 and 391/2025) filed by Naval Associations which also tagged with our Writ Petition. Meantime, I came to know that PCDA has started some recovery of pension from Pre 2016 X-group pensioners. For this, again, I filed an Intervention application in Aug 2025 for urgent hearing of our matters on the grounds as Respondents has started recovery from pensioners like petitioners. On 04.11.2025, we have mentioned in the Supreme Court for urgent hearing of matter. Then our matter was heard on 11.11.2025 and passed the interim Order for stay on any recovery of pension till the final disposal of matter and asked the Union of India to file a counter affidavit at the earliest. On 06.12.2025, Union of India filed Counter affidavit against WP(C) 796/2023 and served the same to AORs for all 4 Writ Petitions. On the next hearing on 08.12 2025, our AOR i.e. ACM Legal has taken time to file rejoinder against this counter affidavit Since, our case is a big financial matter against the Gov of India, our AOR Adv Amitesh Chandra Mishra suggested to engage a Sr. Advocate if it is financially possible. I conveyed this suggestion to all 43 petitioners. Since the cost for engagement of Sr. Advocate is so high, it was impossible to bear for individual 43 petitioners as most are Sr. Citizen. Therefore, we approached all tagged petitioners as an Association of Veterans to engage a common Sr. Advocate for all Writ petitions as matter is the same for all. But no tagged petitioner's Association came forward for the same because tagged petitioners were thinking that filed counter affidavit by Union of India is only for Writ Petition 796/2023 and they were asking for separate counter affidavit from the Union of India against their Writ Petitions however UOI had filed a common counter affidavit for all. Again we 43 petitioners discussed this issue and realised if we as Lead Petitioners are not appearing for further hearing with a Sr. Advocate for Service Matters and for this reason, we loose the case, then there will a life time financial as well as dignity loss for X-group veterans. Therefore we gave a general appeal to all veterans across tri services for financial support according to the individual's wish and capacity to engage Sr. Advocate.and started getting unconditional and unbelievable support from all of you. Then only we are financially capable to engage Sr. Advocate Huzefa Ahmadi till date and hope this will be continued till the final disposal of our matter as it is a matter of dignity for all the veterans across the Tri services.
